Terms of service
Curious K9, LLC (“Curious K9”) provides the finest pet services available, using modern, efficient, and humane methods.
- All fees are payable in full at time of service, unless payment arrangements have been made in advance. All fees are earned upon receipt and no refunds will be given for any reason. Late payments are subject to interest at the rate of 2% per month. Client acknowledges that Curious K9 may, from time to time, adjust its fees and will provide Client advance notice of any such adjustments.
- Client certifies that all vaccinations for any pet utilizing Curious K9’s services are fully up-to-date and will be maintained and updated as necessary. Client further certifies that any pet utilizing Curious K9’s services has at least two sets of shots in the sequence of all vaccinations.
- Curious K9 reserves the right to refuse services to anyone or any pet at any time in our sole and absolute discretion.
- Client acknowledges and agrees that he/she has read and agrees to the additional terms and conditions, including the terms and conditions related to the release of liability of Curious K9 and Client’s responsibility for any action of Client or Client’s pet as specified.
Additional Terms and Conditions
- Client understands and agrees that a “no show” for a scheduled appointment will be counted as a session. Client further understand that lesson duration is determined by Curious K9 or its representative at the time of service and that time spent during the session discussing Client’s pet, pet training and/or behavior is considered training/lesson time. I further understand and agree that if Client’s pet or handler is determined by Curious K9, in its sole discretion, to be aggressive or disruptive the pet can be prohibited from attending training sessions or classes.
- Client acknowledges and agrees that the elimination or modification of behaviors is not guaranteed. Client acknowledges that pet training and lessons will not provide exact results and Curious K9 does not guarantee any outcome or result. Client understands and agrees that the services provided by Curious K9 are inherently dangerous and there is a risk associated therewith. Client agrees that if Client’s pet is injured in a fight or an accident, gets fleas, ticks or worms, contracts any illness or disease, is lost or stolen, becomes pregnant, or engages in any dangerous, vicious or unwanted behavior, during or after all services provided herein, that Client accepts such risk and agrees that Curious K9, its members, managers, agents, representatives, insurers, volunteers, assigns, or other customers, clients, landlords or vendors of Curious K9 of any type, shall not be held responsible for any such resulting injuries, losses, damages, costs or expenses.
- In consideration of the services provided by Curious K9 herein, Client for himself/herself, agents, representatives, and assigns, hereby releases and forever discharges Curious K9, its members, managers, agents, representatives, insurers, volunteers, assigns, or other customers, clients, landlords or vendors of Curious K9 of any type, from all claims, obligations, suits, demands, damages or actions of any type or nature, whether arising in contract, quasi-contract, tort or any other basis in law or equity (“Claims”) arising out of or in any way relating to the services provided herein. Client agrees to indemnify and hold Curious K9 harmless from any and all Claims, including Claims brought by third parties for any action or failure to act by the Client, the Client’s pet or handler as part of or connected in any way to the services provided hereunder.
- This Agreement shall be construed and interpreted in accordance with the laws of the state of Oregon, without regard to its principles of conflicts of laws. If suit or action is instituted in connection with any controversy arising out of this Agreement the prevailing party shall be entitled to recover in addition to costs such sum as the court may adjudge reasonable as attorney fees at trial, on petition for review, and on appeal.
- Client agrees that Curious K9 may use photos or other images of Client or Client’s pet(s) as part of its publications, promotions or advertisements, including website entries, without payment or other consideration. Client understands and agrees that these materials will be the sole property of Curious K9. Client waives any right to royalties or other compensation arising or related to the use of the photograph or images and authorizes the use of Client’s pet(s)’ name.
- Client authorizes Curious K9 to obtain veterinarian services, including emergency veterinarian services when such services are needed for Client’s pet(s) at the reasonable discretion of Curious K9. Curious K9 shall use reasonable efforts to contact Client before obtaining the services. If Curious K9 incurs any expense related to such services Client agrees to reimburse Curious K9 for such expense.
- Client may not assign or transfer its rights or obligations under this Agreement without the prior written consent of Curious K9, which may be withheld in its sole discretion.
- Client understand the contagious nature of COVID-19 and that the CDC and many other health authorities recommend physical distancing during this pandemic and that Curious K9 cannot fully protect Client from risks which may be encountered from engaging the services of Curious K9. Client is voluntarily seeking the services and acknowledges this may increase risk of exposure to COVID-19. If Client shows symptoms of COVID-19, Client will notify Curious K9 and will seek and follow advice from Client’s primary care physician. Client understands the inherent risks and dangers involved with participation in the services and acknowledges and accepts the existence of risks which are predictable risks, as well as risks that are unpredictable and not obvious. Client, in consideration of myself and my pet and any other participants, and any legal representatives, heirs, and assigns, hereby release, waive, and discharge Curious K9, its officers, directors, employees, agents, and representatives, as well as other participants in the Curious K9 services, from any and all liability for any and all loss or damage, and any claim or damages resulting therefrom, on account of any injury, illness or exposure to and/or contracting the corona virus (COVID-19) or other biological agents, virus, or similar bacterial agent by Client or Client’s pet, including any medical expenses, injury and/or death.
Cancellation & Reschedule Policy
We require at least 48 hours’ notice for any cancellations or rescheduling. Cancellations made with less than 48 hours’ notice or no-shows will result in a forfeiture of payment. We do not offer refunds for any reason. If a service is cancelled before 48 hours of the start time, store credit may be issued after approval from the store owner.
